Certificate of tolerance
What is a certificate of tolerance?
Why do you need this document and what are the conditions for obtaining it? Everyone has to deal with things sometimes, which he does not fully understand. Who has not played the role of a mechanic, a teacher, psychologist, stylist, even a doctor? Sometimes these incarnations are satisfyingly successful, other times – a complete disaster. Fortunately, you don't have to be an expert in everything. Right, that's what the pros are for.
CONSTRUCTION, BUILT WITHOUT CONSTRUCTION DOCUMENTS, OR OTHERWISE TOLD – ILLEGAL, MAY BE DECLARED "TOLERANT" THROUGH A CERTIFICATE OF TOLERANCE. FOR THIS PURPOSE IT MUST MEET CERTAIN CONDITIONS, SPECIFIED IN THE LAW.
The first of these is that it was built before 31.03.2001 year. In addition, it is necessary that its construction was permissible or according to the regulations, who were operating at the time of its execution, or according to the currently effective regulations of the ZUT (Territorial Planning Law). Last but not least, in order to reach this procedure, the necessary permits and documents for the construction must be missing. "Building, built up to 31 March 2001 Mr., for which there are no building documents, but were admissible under the regulations, which were operating at the time, when they are done, or under the provisions in force under this Act, are tolerable constructions and are not subject to removal or prohibition of use. They can be the subject of a transfer transaction after presenting a certificate from the authorities, which are authorized to approve the relevant investment projects, that the constructions are tolerable" PZR (Transitional and Final Provisions) ZUT § 127. (1).
Perhaps the most important thing, what you need to know about the tolerance certificate is, that it does not legitimize the building, to which it refers. However, this document serves several useful functions. First of all, it "blocks" the possibility of your construction being removed (destroyed) or prohibited from use. Furthermore, without it you cannot even sell, gift or exchange, nor to mortgage illegal property.
To obtain a certificate of tolerance, you will need a number of documents. You need an application (free text); title deed or notarized consent from all owners; current sketch, issued by the regional administration for the location of the object; notarized declaration for the period, in which construction is completed; copies of the detailed layout plans at the time of construction of the building, as well as from the plans, currently in effect; geodetic survey with reflected storey, area and distances to property and regulatory boundaries (in the case of reduced distances to property boundaries, notarized consents from all owners of neighboring properties should be submitted); photographic material of the object.
